California DUI Cases
It is a misdemeanor in California to drive under the influence of alcohol or
with a BAC of .08 or higher. California DUI penalties
can include
probation, jail time, fines, alcohol classes and drivers license suspensions. Felony DUI can be charged on a fourth drunk driving offense or for a
DUI
causing injury; vehicular manslaughter
or murder can be
charged if someone is killed by a drunk driver.
If your BAC is measured at .08 or higher, a DMV hearing
will be
held to determine whether your license will be suspended. A California DUI
attorney can represent you at the DMV hearing. You have 10 days from the
date of the DUI arrest to contact one of the California DMV drivers safety
offices to request your hearing. If your license is suspended, and you
are caught driving without a license, you will be charged with a
separate crime and face mandatory jail time.
San Bernardino DUI Cases

prosecutes all DUI cases
within the county. You can look up DUI cases on the San Bernardino courts
website. The San Bernardino D.A. has set a policy requiring at least 45
days jail on a second offense DUI and 180 days jail on a third offense DUI. If
you were arrested for DUI/drunk driving in San Bernardino County, speak with a San
Bernardino drunk driving attorney or a San Bernardino DUI lawyer
to help you contest the charges.
Riverside DUI Cases
DUI cases in Riverside County are prosecuted by the
Riverside District
Attorney. The courts and prosecutors in Riverside County are known to
be especially harsh in terms of DUI penalties, imposing at least 10 days jail
even in a first DUI offense. A competent Riverside DUI defense attorney
is your best resource for avoiding these harsh DUI penalties.
Rancho Cucamonga DUI Cases
DUI cases in Rancho Cucamonga, Ontario and Montclair are prosecuted at the
Rancho
Cucamonga courthouse. A Rancho Cucamonga DUI Attorney
can
assist you in fighting these DUI cases. As in san Bernardino, defendants
convicted of DUI in Rancho Cucamonga generally face 45 days jail on a second
offense and 180 days jail on a third offense.
Lewd Conduct Cases
California law defines two classes of lewd conduct cases:
lewd conduct in
public, which is touching oneself in a sexual manner in a public place,
and lewd acts with a
minor, which is the touching of a minor with
sexual intent. Lewd conduct in public is defined in Penal Code 647 (a)
and lewd acts with a minor is defined in Penal Code 288. A
separate offense of indecent exposure
is defined in Penal Code 314.
Expunging Criminal Records in California
A criminal record expungement
is available in California upon
successful completion of probation. An expungement allows you to withdraw your
plea of guilty or no contest and have the case dismissed. Some felonies can be reduced
to misdemeanors at the completion of probation as well. Other forms of
post-conviction relief in California include a certificate of rehabilitation, a
pardon from the governor,
destroying arrest records
or sealing juvenile records.
