Federal Court to Consider Consolidation of Shoulder Pain Pump Litigation - Tomorrow the United States Judicial Panel on Multidistrict Litigation will hear arguments on motions filed to consolidate all Federal shoulder pain pump litigation before one court for pre-trial proceedings. A number of product lawsuits have been filed in different federal courts throughout the country against the manufacturers of infusion pain pumps, including DJO, Inc, I-Flow Corp, Breg Inc and Stryker Corp. These cases allege that the intra-articular use of the pain pumps after arthroscopic shoulder surgery causes a severe and debilitating condition known as Post-arthroscopic Glenohumeral Chondrolysis (PAGCL). Lawyers for the plaintiffs will argue that the shoulder pain pump litigation should be consolidated for discovery and pre-trial motions before one judge. A federal procedure, known as multidistrict litigation or MDL, allows for the consolidation of pending civil cases which have a common background. What is a Pain Pump? - The pain pump is designed to deliver medication directly to the surgical wound site or in close proximity to the nerves associated with the surgical area for post-operative pain management. The pain pump infuses the medication at an hourly flow rate or combination of an hourly flow rate and controlled bolus doses. A recent study published by The American Journal of Sports Medicine identified intra-articular pain pumps (aka post-operative pain pumps) as the likely cause of a condition known as chondrolysis.

Lawsuits Filed Over Shoulder Pain Pump Injuries - A variety of pain-pump makers are being sued over claims that the medical devices caused pain and permanent damage.  The nine patients in Arizona are asking for $68 million in damages, reports BizJournal. But these nine patients are only a small handful of the approximately 100 lawsuits across the country that allege similar, permanent problems with the devices, said BizJournal.  The plaintiffs in the Arizona case allege that the device makers neglected to alert those in the medical community that implantation with these devices could lead to painful and permanent cartilage damage.  BizJournal also said that the device makers did not advise physicians that the U.S. Food and Drug Administration (FDA) refused them clearance—on a number of occasions—to market the device for use in the shoulder joint. The use of intra-articular pain pumps in shoulder surgeries has been associated with a condition called Postarthroscopic Glenohumeral Chondrolysis (PAGCL):  Deterioration of cartilage in the shoulder following such procedures.   Once damaged, cartilage cannot repair itself.  An intra-articular pain pump catheter is placed into the shoulder joint and remains in the joint for several days to deliver pain medication to the shoulder.

Nine Arizonans suing pain pump manufacturers for damage to cartilage - Nine shoulder-surgery patients in Arizona have filed lawsuits against national pain-pump manufacturers alleging the medical devices caused permanent and painful damage. They’re asking for a total of $68 million in damages. The nine are among about 100 lawsuits across the nation alleging the injuries were a result of implanted devices delivering local anesthetics directly into shoulder joints. Plaintiffs allege the manufacturers failed to warn the medical community that using the pumps in this manner could cause permanent cartilage damage. Some pain-pump manufacturers failed to tell doctors that the U.S. Food and Drug Administration denied them clearance several times to market the device for use in the shoulder joint, according to Laura Kalur of Kalur Law Offices in Portland, Ore., one of the lead attorneys in these cases.

These companies have also not warned people that the FDA had not permitted the use of pumps in the joints. Doctors say that the FDA had approved of this device just for the external purpose, not to be used inside the joints.
